These terms and conditions govern the relationship between the tourist (“the Client”) and the independent tour guide (“the Guide”) selected through the platform, defined as guidescr.com and guidescr.net (hereinafter, “The Platform”).
1. Acceptance of Terms
By making a reservation and payment for a tour guide service through The Platform, the Client expressly accepts these terms and conditions, as well as the specific terms and conditions set forth by the Guide, which are available via a link provided in their profile.
2. Nature of The Platform
The Platform is a technological intermediary that facilitates contact between Clients and certified tour guides in Costa Rica. The Platform is not a travel agency or a tour operator. The Platform does not offer, organize, sell, or manage tours or guide services. The service, its quality, safety, and the execution of the tour are the exclusive responsibility of the Guide selected by the Client. The Platform does not have an employment or contractual relationship with the guides; it is solely a contact facilitator.
3. Guide’s Responsibility
The Guide is an independent professional and is solely responsible for providing the service. This includes, but is not limited to:
- The truthfulness and accuracy of the information provided about the tour.
- The adherence to the itinerary and the duration of the service.
- The safety and well-being of the Client during the tour.
- Possessing the necessary certifications, permits, and insurance to operate legally in Costa Rica.
4. Exemption of Liability of The Platform
The Client acknowledges and accepts that The Platform is exempt from all liability for any loss, damage, injury, accident, cancellation, or any other incident that occurs during or as a result of the service provided by the Guide. The Platform does not supervise or control the execution of the tours and does not guarantee the conduct or professionalism of the guides.
5. Reservation and Payment Process
Reservations are made through The Platform. Payment is made directly to the selected Guide using the PayPal payment system. The Guide will be notified of the reservation and payment.
- Cancellation and Refund Policy: The cancellation and refund policy is established and managed individually by each Guide. To know the exact terms, the Client must review the Guide’s terms and conditions link in their profile before completing the reservation. Once the reservation is confirmed, the Guide’s cancellation policy cannot be modified for that transaction.
- Payment Disputes: Any dispute related to payment, refunds, or the provision of the service must be resolved directly between the Client and the Guide through PayPal. The Platform does not intervene in these disputes.
6. Client’s Duties
The Client agrees to:
- Provide accurate information at the time of reservation.
- Respect and follow the Guide’s instructions during the tour.
- Inform the Guide of any medical conditions, allergies, or physical limitations that may affect the tour’s development or their safety.
7. Applicable Law
These terms and conditions are governed by the laws of the Republic of Costa Rica. Any dispute arising from this relationship will be resolved in the competent courts of Costa Rica.
8. Modifications
These general terms and conditions may be modified by The Platform at any time. The Client is advised to review these terms regularly.
